The Nature of Individual Rights: Short Notes

Bill of Rights - First Ten Amendments to the US ConstitutionSome short notes about the nature of genuine human rights. I start by clearing up some common misconceptions about rights, then discuss what rights actually are.

What Rights Are Not

  1. Rights do not come from religious texts, like the Bible. Biblical Commandments like “Thou shalt not murder,” and “Thou shalt not steal,” don’t provide an answer to what killing counts as murder, or what taking counts as stealing. In the Biblical book of Exodus, priests and leaders may kill those in their community who are not attacking them, and it is apparently not considered murder. (See: Exodus 32:27-29) Also, many early Christians eschewed private property and lived a communal lifestyle, with all things held in common. (Acts 2:42-45) The Judeo-Christian tradition relies on the arbitrary dictates of the Biblical God and does not provide a solid basis for rights to life, liberty and property.
  2. Rights are not moral duties or “side constraints” on purposeful action, as many academic libertarians believe. They don’t have their basis in some vague concept of “inherent human dignity.”
  3. Rights are not means to “general utility”–i.e. the “collective pleasure” of everyone in society–as John Stuart Mill thought.
  4. Rights do not protect need-based claims to goods or services to be provided by other people, such as food, shelter, healthcare, etc. Contra Bernie Sanders, healthcare is not a right.

The Elements of Moral Philosophy on Ethical Egoism: A Critique

The Elements of Moral Philosophy - Sixth Edition CoverMany college philosophy classes today discuss ethical egoism. Many take as their main source the work of James and Stuart Rachels, in their book, The Elements of Moral Philosophy. The main philosopher referenced in the Rachels’ discussion of ethical egoism in Elements is Ayn Rand. But their account of Ayn Rand’s Objectivist ethical theory and their arguments against it are problematic. Their account of her theory is not entirely accurate, and their arguments against it miss important considerations.

Here, I will look at how they present ethical egoism, including the arguments they present for and against it. Where appropriate, I’ll use this discussion to show how their conception of Ayn Rand’s theory is faulty. (After this point, I will refer to “Rachels” in the singular. The reader can take it to refer to whichever Rachels is responsible for the essence of the content.)

Part 1: “Duty” and Ayn Rand’s Ethics

On page 63 of Elements (6th Ed.), Rachels says:

[Ethical Egoism] holds that our only duty is to do what is best for ourselves.

This is not a good way to talk about Ayn Rand’s ethical theory, because Rand doesn’t accept moral duties as legitimate. Rand only thought that there were moral obligations, not duties. This may seem like a minor issue of semantics, but it is actually a deeply revealing point about how Ayn Rand’s conception of ethics is different from most other philosophers’.

In the field of morality, a “duty” means a rule that one must allegedly follow, apart from one’s own interests or happiness. When we do something because we see that it will cause something else that we want for our own happiness, we do not call that “following our duty.” For example, if I work and earn money to buy a new gaming computer, my working is not following a duty. It’s doing something in order to get something else for myself. Or again, if I invest in a company to get a larger return on my investment later, we do not say that I am investing out of duty. If I help my wife because her happiness is important to my own, that is not following a duty, but doing something that improves my own life and promotes my happiness. I help her because I genuinely want to, not because I have a “duty” to.

How Christian Morality Promotes Despotism Over Liberty

The Statue of Liberty. Lady Liberty needs moral theory for support.Many Christians, especially conservatives in the US, will tell you that Christianity is compatible with liberty. Some will even say that it’s the foundation of liberty. After all, isn’t one of the Biblical Commandments, “Thou shalt not steal”? So the people in government have no business stealing through coercive taxation. And didn’t Jesus practice non-violence and admonish followers to give to the poor themselves, rather than forcibly taking money from others to donate? What business do the people in government have doing this, if they’re going by Christian morality?

Yet the countries of Europe have a long history of dictatorial rulers, while seeming to be very heavily Christian. In the Middle Ages, feudal lords ruled over their subjects–especially serfs–with near-absolute power. Kings and popes strove to maximize their authority over their subjects, to rule as Christian monarchs. In the 17th Century, the Christian king of France, Louis XIV, was especially successful at becoming an absolute monarch. The pope was extremely powerful, often like a monarch in his own right. This continued, even as priests and noblemen knew about the Roman Republic of antiquity.

Burning at the stake was one of the punishments for heresy or witchcraft. It was used as punishment for these “crimes” up to 1,300 years after Christianity first dominated Europe.

During the Middle Ages, and even into the Renaissance, the Roman Catholic Church put people on trial for “heresies,” (differences of religious belief) and if they were convicted, they were handed over to civil authorities to be imprisoned, hanged, or burned at the stake.

Persecution for heresy was not even limited to official acts carried out by the civil/religious authorities. Ordinary people–commoners and peasants–sometimes formed mobs and burned alleged heretics themselves, without trial.

Popes sanctioned wars of conquest, like Charlemagne’s wars to conquer Saxony and Lombardy, the Norman invasion of England in 1066, and multiple crusades to conquer the Holy Land.

Even after the Protestant Reformation, there were Protestant despots like King Henry VIII and Oliver Cromwell of Britain, and Charles IX of Sweden who were cruel and tyrannical, and who violated the religious freedoms of their subjects. Religious wars continued to rage across Europe, such as the Thirty Years’ War.

All of this occurred during a deeply religious and almost universally Christian era in Europe’s history. By virtually every measure, people during the 1,300 years between the fall of the Roman Empire and the Enlightenment, were far more religious than in the past 300 years. They went to church more often, prayed more often, relied on the Bible more, were less concerned about earthly life and more concerned about whether they were headed for heaven or hell. They became passionate and even violent over religious disputes, and most of them had no tolerance for heresies, paganism, or atheism. (Atheism was basically unheard-of.)

Was all of the oppression and war some bizarre, inexplicable, 1,300-year fluke of history? Did a crazy corruption of Christianity somehow reign for 1,300 years, amid widespread and profound religiosity?

In the rest of this essay, I will argue that these 1,300 years were no fluke and no corruption of the fundamental ideas of Christianity. What may seem like a corruption to some superficial, modern interpretations of Christian ideas, is in fact a logical consequence of the deeper ideas of Christian morality. Christian morality ultimately supports statism and oppression of the individual, not liberty and individual rights.

The two major moral tenets that support statism are: self-sacrifice for others, and faith.

Why Moral Theory is Needed in the Fight for Liberty, Not Just Economics and the Non-Aggression Principle

The Statue of Liberty. Lady Liberty needs moral theory for support.Many libertarians will tell you that moral theories have relatively little to do with their advocacy of libertarianism. They think that liberty is morally neutral. Their thinking for why this is so is basically that liberty enables people to live by all sorts of different moral ideas. It doesn’t favor any morality over others, they think, so liberty itself must be morally neutral.

To the extent that some libertarians think that morality is involved, it’s usually just conventional ideas that you shouldn’t harm others, steal from others, etc. So they think that all one has to do in arguing for liberty is to talk about something like the Golden Rule or the Non-Aggression Principle, and show that liberty has good economic consequences.

Or, if they’re doctrinaire students of Austrian economics, they may think that the need of liberty can effectively be derived from praxeology–a “purely descriptive discipline” studying human action–without any need to resort to moral ideas.

But in this essay, I will argue that a controversial moral theory is deeply involved in any advocacy of freedom, and that in order to be persuasive on a cultural scale and achieve a lasting victory, advocates of liberty must make a deliberate break with today’s conventional morality. They must advocate for a full moral theory based on reasoning, not just the “conventional wisdom” that’s widely accepted without thought.

Statists are Guided by Moral Ideas, not Economic Ones

The argument from “good economics” is a very common one among libertarians: Free market policies lead to economic prosperity, and therefore we should enact those policies.

But what if the people you’re arguing with don’t really value economic prosperity? What if they value other things above prosperity? Whatever lip service the political left gives to economics and prosperity, the fact is that they don’t value it–not really. What they actually value are things like “fairness,” “equality,” and “social justice.” To see evidence of this, pay attention to what they talk about first, what they get passionate and angry about. Watch virtually any Bernie Sanders campaign speech, and you’ll find that his main focus is on wealth inequality and “social justice.” In virtually every speech, he will say that large wealth inequality is wrong, immoral, and not what America should be about. He links inequality to economic problems, but his economic arguments are shaky. They don’t really support the use of the government to “equalize” wealth, and most of them have been refuted. (See Equal is Unfair for details on how the arguments against wealth inequality fail.)

Bernie Sanders and many other leftists keep pushing for a higher minimum wage, even though it is very well known among economists that it is bad economic policy and will cause unemployment among the very people it’s supposed to help. (Paul Krugman is an economist who used to know better, yet he has flip-flopped to say that minimum wages should be raised.) Leftists keep trying to implement greater degrees of socialism, even though socialism has been tried countless different ways and has failed to produce economic prosperity again and again. There’s a clear correlation between economic freedom (with property rights protection) and economic prosperity, and the Left has been working against economic freedom and property rights for centuries.

Leftists–for the most part–are not complete idiots, and they’re not insane. So there’s one conclusion left as to why they have kept pushing for policies that destroy economic prosperity: they’re not really after economic prosperity. What are they really after? Take Bernie Sanders’ speeches as a clue: a more “moral” governmental system.

And what about social conservatives who want to legislate against “sins” and what you can do with your body in private? Well of course, this is even more obviously guided by morality.

Libertarians’ Political Ideas Depend on Controversial Moral Ideas

So deep down, statists, both left and right, are focused on morality. But should we be, as advocates of liberty? Should we try to get statists to forget about morality and focus on economics? Well, it turns out that ideas about “good economics”–as well as every other governmental policy capitalists might advocate–ultimately presuppose and depend on moral ideas, whether people are aware of it or not. So moral issues cannot be escaped in political advocacy.

Case in point: What do capitalists mean when we advocate “good economic policies?” Do we mean policies that encourage suffering and famine like in Soviet Russia? No, we mean the policies that will enable people to achieve economic prosperity. And what do we mean by “economic prosperity?” We mean the material conditions that lead to the sustenance and flourishing of human life in this world.

Faith vs. Trust and Science vs. Religion

Does one need to have faith to engage in science or benefit from it? What is trust and what is its role in reasoning? These are the questions I will discuss and answer here.

First, we’ll consider the meaning of “faith.” The most prominent use of the term “faith” is in regard to religion, so let’s look at what it means in that sphere and apply that understanding more generally.

For Christians, the model of faith is presented in the Bible. In Matthew 18, Jesus says, “Truly I tell you, unless you change and become like little children, you will never enter the kingdom of heaven. Therefore, whoever takes the lowly position of this child is the greatest in the kingdom of heaven.” (Mt. 18:3-4, NIV) And again, in Mark 10, Jesus says: “Let the children come to me; do not hinder them, for to such belongs the kingdom of God. Truly, I say to you, whoever does not receive the kingdom of God like a child shall not enter it.” (Mark 10:14-15, ESV)

The reason that Jesus holds children up as models to emulate is that they tend to be “intellectually humble” (i.e. naïve) and will often accept religious teachings simply, without challenging the adults by asking too many difficult questions. Ask virtually any religious 6-year-old why he believes in God, and you won’t get anything resembling rational, philosophical arguments. He accepts God because that is what his parents and minister have told him. This is faith, and this is Jesus’s ideal model.

Ayn Rand, the novelist and philosopher, really enjoyed Christmas.

She was not a materialist; nor was she a mystical spiritualist. She held that there is no conflict between genuine spirituality and the enjoyment of material things. Human beings need material products to survive, and an abundance of material wealth–used under the guidance of proper moral principles–enhances human life and happiness dramatically. Wealth allows people leisure time: Instead of working about 12 hours a day from sunrise to sunset, 6 days a week, having a short supper and going to bed as most people did before capitalism and the Industrial Revolution, most Westerners can now afford to work 8 hours a day, while pursuing hobbies, recreation and friendships after work and on the weekends. People have a greater ability to balance vocational productive work with other pursuits that also contribute to happiness and spiritual contentment.

Rand also held that voluntary trade in a free market is a good, benevolent, win-win interaction: Both parties benefit from the trade, by their own judgment (or they wouldn’t pursue it, assuming they’re not acting self-destructively.) There is no need for anyone to sacrifice the interests of others for his own supposed benefit in free-market trades. (And in fact, sacrificing others cannot bring real benefits, but is self-destructive, all things considered.)

Biblical Inerrancy

It is the official belief of the Southern Baptist Convention that the Bible is the perfect revelation of God and that it is the perfect source of moral instruction. From the SBC website:

The Holy Bible was written by men divinely inspired and is God’s revelation of Himself to man. It is a perfect treasure of divine instruction. It has God for its author, salvation for its end, and truth, without any mixture of error, for its matter. Therefore, all Scripture is totally true and trustworthy. It reveals the principles by which God judges us, and therefore is, and will remain to the end of the world the true center of Christian union, and the supreme standard by which all human conduct, creeds, and religious opinions should be tried. All Scripture is a testimony to Christ, who is Himself the focus of divine revelation.

Here is all the response that that belief needs or deserves:

“If anyone comes to me and does not hate father and mother, wife and children, brothers and sisters—yes, even their own life—such a person cannot be my disciple." -- Jesus, (Luke 14:26)

This is one of many details that varies between the four Gospels, causing them to contradict each other in their content and, to an extent, in their message. Biblical inerrancy is clearly an article of dogmatic, blind faith.

One Internal Contradiction in the Christian Worldview: God’s Omniscience vs. Free Will

Unjust God predestines people, yet judges them morally for actions. I recently found a blog post where a Christian reprints a debate he and his friends had on Facebook with an Objectivist. It’s a very long discussion where a lot of words are written, yet very little actual debate seems to be accomplished. In skimming this wall of words, one point caught my eye: the Christian participants are claiming that what distinguishes the Christian worldview from others–and what makes it the true worldview–is that it is internally consistent, whereas other worldviews are not.

In epistemology, this view–that what makes something true is (solely) its logical consistency with an overall structure of knowledge–is called the “Coherence Theory of Truth.” To say that this epistemological view is problematic is an understatement; it really is a non-starter. My theory of truth is a version of the Correspondence Theory: the only theory I consider tenable.

But my point here is not to attack coherentism or defend correspondence. Beyond the problems of coherentism, the claim that the Christian worldview is internally consistent is blatantly false. There are several places where I could show logical contradictions, but I only need one irreconcilable contradiction to demonstrate internal inconsistency. So I will confine myself to one: the contradiction between God’s supposed omniscience and human free will. (1)

Free will vs. God’s Omniscience

Most Christians are committed, implicitly, if not explicitly, to what I regard as genuine free will. This is the idea that a person’s choice in a given situation is not necessitated by antecedent factors, but represents a selection among alternatives that could also have been chosen in the same circumstance. (In contemporary philosophy, this is called “libertarian free will” as opposed to the alleged alternative, “compatibilist free will.” I will discuss Christians who hold compatibilist views after dealing with the libertarian version.)

Christians also generally believe that God is omniscient, such that he knows the future outcome of people’s choices and can infallibly implement his divine plan. But if God currently knows, with certainty, the outcome of future choices, then this means that there must be a current fact about those outcomes for him to know. If there is a current fact about the outcome of future choices, then those choices are already predetermined. This means that those “choices” are not genuine choices, because there is only one thing that will happen, with no alternative possibilities. Any “choice” is purely illusory, and thus, there really is no free will. So Christians are logically committed both to the position that humans have free will, and to the position that they do not.

Objectivism for Dummies?

I find it a bit strange that one of the top Google auto-completes I see for “Objectivism” is “Objectivism for dummies,” considering that there is no “For Dummies” book on this topic. But what it indicates is that there is significant interest in a basic, understandable introduction to Objectivism, the philosophy of the novelist and philosopher, Ayn Rand.

If this is what you want, I’d like to recommend my Introduction to Objectivism page. Not only does it have a clear and straightforward presentation of the philosophy of Objectivism, but it also has a large number of links to resources for learning more.

I’d also like to recommend reading Ayn Rand’s novels, such as Atlas Shrugged and The Fountainheadif you haven’t recently–to get a fuller feel for the type of person that Objectivism praises, and the type of life that it holds out as an ideal. As I like to caution, however, Rand’s novels are romantic novels, and they feature extraordinary and dramatic situations. The principles her ideal heroes live by are the ones she advocates, but one must be careful about being too literal, (or, in Ayn Rand’s terminology, “concrete-bound” or “anti-conceptual”) in applying those principles to real life.
